Katie Pearse Productions will provide podcast production services to Client on the following terms:

1. Podcast Production: Producer agrees to record and produce a podcast episode featuring Client’s voice and story. Client acknowledges that the final podcast will be edited by Katie Pearse Productions and may be posted on Apple Podcasts, Spotify, Audioboom, and any other major streaming platform for public consumption. The podcast will remain posted to major streaming platforms for 10 years.

2. Client agrees to allow Producer to use the photograph and finalized recording on social media and hearingourheritage.com for advertising purposes. 

3. Ownership and Use: The Client owns the rights to the original recording of their voice and story. However, they acknowledge that by agreeing to this contract, they are granting the Producer the right to use their recording for the purposes of producing the podcast episode. Client recognizes that anyone will have access to their voice, stories and episode once it is posted on the major streaming platforms.

4. Delivery: Producer will deliver the final product to Client in the form of a .mp3 file of about sixty minutes. Client will receive via email and can also access via links to Apple Podcasts, Spotify, and other major streaming platforms. Delivery date will be no later than two months after recording. 

5. Payment: Client agrees to pay $495 for one episode. The first half of the cost, or $247.50, is due upon scheduling the first interview time.  $247.50, or the second half of payment is due upon delivery of the product. The first half of the payment will be made on this website.

6. Scheduling: Client may change the agreed upon recording times up to 48 hours before each recording. Should a scheduling conflict arise within 48 hours, a $25 fee will be added to the final payment. 

7. Changes: There is a one week window for any changes they would like to have made to the podcast upon completion.

8. Representation: Producer agrees to choose audio segments that best represent the interviewee and agrees not to include overly personal details or cast others in a negative light.

9. Termination: Katie Pearse Productions reserves the right to end this Agreement at any time, provided written notice is given to the other party. If Katie Pearse Production terminates the contract, a full refund will be given to the Client. The Client may terminate the contract until completion of the first interview. If this Agreement is terminated, the Client is not obligated to complete payment of the remaining balance ($247.50).

10. Removal of Podcast: The Client may choose to have the podcast removed from public access via streaming platforms at any time. Removal of the podcast from streaming platforms does not result in a refund of payment.

11. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of [state].

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, negotiations, and understandings, whether written or oral. This Agreement may not be amended except in writing signed by both parties.

By signing below, the parties acknowledge that they have read and understand the terms of this Agreement and agree to be bound by them.
